Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the AI Coco website and mobile applications (the "Service") operated by AI Coco ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Use of Service

Our Service allows you to use various AI-powered features and tools. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation
  • To impersonate or attempt to impersonate AI Coco, an AI Coco employee, another user, or any other person or entity
  • In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service

3. User Content

Our Service may allow you to provide certain content, including but not limited to photos, images, and text ("User Content"). You retain any and all of your rights to any User Content you submit, post, or display on or through the Service.

By providing User Content to our Service, you grant us (and our third-party service providers) a non-exclusive, worldwide, royalty-free license to use, process, and transform your User Content solely for the purpose of providing the Service to you.

You represent and warrant that:

  • You own the User Content or otherwise have the right to provide it
  • The User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person

4. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of AI Coco and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AI Coco.

5. AI-Generated Content

Our Service uses artificial intelligence to generate content based on your inputs. You acknowledge that:

  • AI-generated content may not always be accurate, complete, or appropriate
  • You are responsible for reviewing and verifying any AI-generated content before use
  • We do not guarantee specific results from our AI features
  • AI-generated content should not be used for any unlawful, harmful, or inappropriate purposes

6. In-App Purchases and Subscriptions

Some of our apps offer in-app purchases and subscriptions. By making a purchase:

  • You agree to pay the applicable fees and any applicable taxes
  • Subscriptions automatically renew unless canceled before the renewal date
  • You can manage your subscriptions through your App Store account settings
  • Refunds are handled according to the policies of the respective app store (Apple App Store or Google Play Store)

7. Third-Party Services

Our Service may contain links to third-party websites or services that are not owned or controlled by AI Coco. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that AI Coco shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

8. Limitation of Liability

In no event shall AI Coco, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

9. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

10. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
